Throughout the site (threerosesbeauty.com), the terms “Three Roses Beauty”, “we”, “us” ,“our”, “the seller”, refer to the owner of the site  –  “Sistars group”, company reg. No.: 20358884 , with headquarters and registered address: 26, J.Venelin street, 9000 Varna, Bulgaria. Three Roses Beauty offers this website, including all information, tools and services available (the “Service” ) from this site to You -” the user”, ”the client”,”you”, “your”, “the customer”, “the buyer” conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

TERMS AND CONDITIONS

  1. Opening provisions:

1.1.Under our “Terms”, we define the relationship between our company – “Three Roses Beauty”, as the seller and operator of the e-shop at www.threerosesbeauty.com, and “You”, our customer.

1.2. “Three Roses Beauty” is a online shop operating from Bulgaria and available in English language, as all further communication that may occur with our clients.

2.Placing an order – contract:

Orders may be placed online trough our online store (www.threerosesbeauty.com). Before finalizing your purchase, you can review and revise the products in your shopping basket at any time.  In the case of a purchase agreement concluded remotely(online), the order placed by the order’s submission on our website shall constitute a draft purchase agreement. We will confirm the receipt of your order with an e-mail. A purchase agreement shall be concluded only when we ship the ordered products to you and we confirm the shipping with a second e-mail (shipping confirmation).

The presentation of products on our site does not constitute a binding offer.

We reserve the right to limit the maximum amount of products that you can purchase per order.

  1. Delivery policy:

2.1 Dispatch – 1 to 3 days* (in some cases 5 days) depending on products availability.

2.2 Delivery – 3 – 20 days* depending on destination and season.

2.3 Shipping costs for your order are non-refundable and are based on the weight of the items you order and your location.

2.4 The date of delivery for your order may vary due to carrier shipping practices, delivery location, method of delivery and the quantity of items ordered

2.5 All delivery terms have an indicative character; Three Roses Beauty shall not be liable in any way if delivery takes place at a later date.

2.6 In case that you cannot be found by the courier at the address that you have provided, and you were advised of the delivery date with a reasonable period of time, you shall bear the costs for the unsuccessful delivery.

2.7 Additional shipping charges may apply depending on your location and the size of your order. You are responsible for all taxes applicable to the delivery of your order, including sales tax, value added tax, custom duties and excise duties.

2.8 If there is any damage to the items that you ordered, upon delivery, you must contact us within 5 days from receipt of your order and provide us with photographical evidence.

2.9 All orders, made after Friday 12:00 will start being processed on Monday, following the weekend of the order.

3.1. Product information on our website is not intended to diagnose, treat, or prevent any disease or health condition. The content of the pages of our website is for your general information and use only. It is subject to change without prior notice.

3.2. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

3.3. We shall not be liable for any allergic reactions or other health conditions provoked from the use of any of the products we sell in our website.

3.4. All products must be strictly used as described by the manufacturer. Three Roses Beauty is a reseller of cosmetic goods and not a producer.

  1. Prices:

4.1 All prices are in Euro and do include VAT (20% as per Bulgarian legislation);

4.2 All prices are exclusive of delivery charges;

4.3 Delivery charges are visible at the checkout, before finalization of an order;

4.4 Prices of products are subject to change without prior notice.

  1. Information on our website and our social media channels:

We will always do our best to make sure that all information provided on our website and social channels is accurate and up to date, however occasionally some of the information and materials may contain inaccuracies, omissions or errors (that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability or other) and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the “Terms” or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose.

  1. Payment:

6.1 Available payment options for International options: Credit or Debit Card;

6.2 By using and verifying a credit card, you confirm that the card is yours;

6.3 All credit card holders are subject to validation checks and authorisation by the card issuer;

6.4 If the issuer of your card refuses to authorise a payment we will not be liable for delay or non-delivery;

6.5 After selecting credit card payment you will be transferred to  3D Secure platform to fill in the data. If the transaction is authorized, the payment proceeds immediately and we can start proceeding with your order the very next day.Our staff does not operate with your card data. The process is finished through online banking.

  1. Security:

We do not store credit or debit card details.

  1. Return, Replacement and Right of withdrawal

8.1 Right to withdrawal – According to the European Union’s Distance Selling Regulations you have the right to waive your online order (you must do it in writing at info[at]threerosesbeauty.com), from the moment you have made the order until 14 days after receiving the order. The delivery cost for the receiving and returning of the products, if no fault is found with the products will be paid by you – the buyer. All products must be unopened and unsealed and there shouldn’t be any sign of use. You do not have the right to waive your purchase if the products were unsealed, opened or tested. The refund (excluding the shipping costs) will be returned to the original credit or debit card account used to make the online purchase. The refund will be made within 30 days of the receiving of the written notice, however we reserve the right to refund you, after the return of the goods;

8.2 Incomplete order, damaged or faulty products – In case that you have received damaged, defective or wrong products – the products that you have received are not the products you have originally ordered, you have the the following rights:

We reserve the right to ask for photographical evidence of any such damage and you are obliged to cooperate. 

(a) Exchange:

When exchanging damaged or faulty products or incorrect deliveries, we will dispatch replacement items to you free of charge provided you first return the products in your order to us in the condition in which you received them.

(b) Refund:

When returning damaged, faulty or incorrect orders we will refund (to the original credit or debit card account used to make the online purchase):

1.) the full purchase price;

2.) the delivery charges incurred in delivering the products to you (where only part of an order is returned to us, we may reduce the amount of the delivery charge we refund you to account for the delivery costs of those items sent to you and not returned); and

c) the shipping costs to return the products to us,

provided you first return the products in your order to us in the condition in which you received them.  If you fail to return products to us we may charge you for the products or the cost incurred in collecting them from you.

The above provisions do not affect your statutory rights.

You should return the goods within 14 days of the date of delivery. Please provide a copy of the delivery note and invoice. We will reimburse the cost of postage and packing, unless you request a replacement item. If you request a replacement for returned items you will not be charged again for delivery. All replacement items are shipped via standard delivery.For hygiene reasons we are unable to offer a refund or exchange on any opened product.

If you wish to cancel your order, before it was shipped please notify us at info[at]threerosesbeauty.com. Please quote your order ID.

8.3   Contract withdrawal is not possible for services – the option is available for products only, not the gift wrapping service or other kind of service;

8.4 Please note that an increased sensitivity or allergic reaction to the delivered goods cannot in itself be deemed a defect in the goods. Likewise, shortcomings in gifts and other gratuitous performance we provide beyond the scope of your order do not constitute a defect. Pictures of goods in our e-shop are illustrative only and do not constitute a binding depiction of the goods’ properties (for example, the packaging may differ due to a change made by the manufacturer).

       9. Risk:

Your order will be delivered to the place of delivery specified in your shipping confirmation. Risk of loss, damage and theft of the products transfers to the you upon delivery and from there on.

Products shall remain our property until full payment of the purchased items including any transportation charges.

  1. Working hours – Three Roses Beauty, operates from 9.00-18.00 Monday to Friday.
  2. Age – When placing an order you agree that you are at least the age of majority in your country or state of residence.
  3. Changes to our Terms and conditions and Privacy policy:

We reserve the right to change our Terms and conditions and Privacy policy. It is your responsibility to follow and read them every time you use the website.

We, at Three Roses Beauty do respect the privacy of our Customers. We do not collect data unnecessarily. However in order to run our online shop we do need to collect specific data from you. We are committed to treating your personal data (e.g. your name, address, telephone number, e-mail address, billing and delivery address) with respect and in the strictest confidence. FOR HOW LONG IS PROCESSED YOUR DATA?

  1. Data provided on a contractual basis:Online order data – until 5 years from the date of the specific order. The term is determined on the basis of the limitation period for repayment of the receivables.
  2. Data relating to the collection and verification of accounting data and accounting compliance- accounting records and financial statements, including tax audit, audit and subsequent financial inspection documents, shall be kept for 10 years from 1 January of the reporting period following the reporting period, to which they refer; all other holders of accounting information – three years from 1 January of the reporting period following the reporting period to which they relate;
  3. Data provided by consent- to its withdrawal, as provided, including by deletion. Your data in our social media channels or our website are related to the comments you posted on articles and videos because they represent the exercise of your constitutional right to free expression in your chosen format and content. Therefore, no deadline is set after the expiration of which processing ceases, and instead you are given the opportunity to remove the published content by exercising your rights as a data subject in the form and manner prescribed in this Policy.   • The processing is unlawful you can oppose the erasure of personal data and instead request the restriction of the use of your personal data instead;     or
  • If the Controller no longer needs the personal data but it is required by you to defend legal claims.

You may object to the processing of your personal data based on the legitimate interest of the Controller (Three Roses Beauty) or a third party. Our main mission is to make Bulgarian cosmetics accessible and popular around the world. To do this, we send information to our customers about the positive qualities and properties of the cosmetics we offer. In turn, you have the right to object to receiving marketing communications, including profiling and analysis for direct marketing purposes.

Right to appeal to a supervisor in the Member State of habitual residence, place of work or place of suspected violation if you consider that the processing of your personal data is in breach of the provisions of Regulation (EC) 2016/679, or as also known the General Data Protection Regulation (GDPR).

The aforementioned rights shall be exercised by written request in the form determined by the Administrator, which you can get at the seat of the Controller or electronically upon request to the Data Protection Officer of the Controller and filling the received in response electronic form by applying the necessary documents.
You will receive an answer to your request within one month of receipt of your written request.

Age of customers

We will never knowingly collect or solicit Personal information from individuals under the age of sixteen (16) without first obtaining verifiable parental consent. If you are under the age of 16 you should not provide information to us. If we become aware that a person under 16 has provided Personal Information to us without verifiable parental consent (as may be the case where the information is provided via our web site or social media channels), we will remove such Personal Information from our files and web channels.

We do not use automated algorithms and / or profiling.
